Apple cannot be forced to turn over iPhone data to the Federal Bureau of Investigations, a New York judge ruled Monday in relation to a Brooklyn drug case. The decision comes nearly two weeks after a California judge ordered the tech giant create software to help the U.S. government retrieve information from the locked iPhone of San Bernardino shooter Syed Farook. Apple has reportedly been asked to fork over private information from more than dozen other iPhones in other criminal cases.

Yes, because all cases are not equal. Trying to get data from a terrorists phone is much different than some run-of-the-mill criminal case.
